TITLE: Title
AN ORDINANCE BY THE TROTWOOD CITY COUNCIL TRANSFERRING 5.148 ACRES OF LAND LOCATED WITHIN THE SHERWOOD PARK TRACT, PARCEL ID NO. R72 16101P0000, BY QUIT CLAIM DEED TO FIVE RIVERS METROPARKS TO EXTEND THE WOLF CREEK RECREATIONAL TRAIL FOR THE PUBLIC’S BENEFIT AND DECLARING THE PROPERTY SURPLUS.
Body
PURPOSE: Transfer Surplus Property
DEPARTMENT: Law Office
CONTACT INFORMATION: Chris Conard, Law Director
INFORMATION: There is an orphaned park parcel located in the City of Dayton, but believed to be owned by the City of Trotwood, that Five Rivers MetroParks would like to acquire for a proposed extension of the Wolf Creek recreational trail.
On the county records, there is no owner of record. Based on a title search, the last owner was George Rowlett, the developer of a subdivision who filed a plat in 1927 showing this parcel as a public park. At that time, the property was in Madison Township so if the “public park” designation was intended as a dedication, the recipient was the Township. When the property was later annexed into the City of Dayton, this would not have changed the Township’s ownership of the park. Trotwood, as the successor by merger, is probably the owner, though its title is somewhat uncertain.
Knowing these facts, the City would like to quit claim to Five Rivers, whatever rights it may have to this orphaned park property.
