A RESOLUTION BY THE TROTWOOD CITY COUNCIL DECLARING THE EXISTENCE OF A PUBLIC NUISANCE AND DRAINAGE-RELATED CONDITIONS AT THE PROPERTY LOCATED AT 3285 NORTH SNYDER ROAD, PARCEL ID NO. H33 02205 0028, AND DIRECTING THE PROPERTY OWNER TO TIMELY REMEDIATE THESE CONDITIONS IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY, AND WELFARE.

INFORMATION: Section 929.31 of the Trotwood Code of Ordinances states that whenever the City Manager or his designee finds that a tract of land is inadequately drained, or that there is an obstruction to a culvert, covered drain, or other natural or man-made watercourse that interferes with water naturally flowing therein or that such culvert, drain, or watercourse is of insufficient capacity to reasonably accommodate the flow of water, as required by this chapter, the City Manager or his designee shall notify the owner or person having possession, charge, or management of such land to remove the obstruction or provide the necessary drainage. This Section, along with Sections 929.32 and 929.33, prescribes the process by which the City and the owner must address this issue and should the owner continue to not comply, City Council, after affording the owner the opportunity to be heard, may, by resolution, direct the owner to remediate the drainage-related issues. Should the owner fail or refuse to comply with Councils resolution, the City may perform the required work and charge the owner the abatement costs.
FISCAL & STAFF IMPACT: Should the City have to perform the required work to correct the drainage-related issues, the property owner will be charged all abatement costs incurred by the City, which costs will constitute a lien on the property.
