TITLE: Title
AN ORDINANCE ADOPTING NEW SECTION 333.11 "CIVIL PENALTIES FOR HAND-HELD SPEEDING SYSTEM VIOLATIONS" OF THE CITY OF TROTWOOD CODIFIED ORDINANCES.

PURPOSE: This is a new section under Chapter 333 of the Trotwood Codified Ordinance. It will allow the use of a Hand-Held Speed Measuring and Camera device by the Police Department. The new section is developed in compliance with SB 342 which passed last year and went into effect in march of 2015.

INFORMATION: The new ordinance is Section 333.11 and is a Civil Action. Under this Ord., officers can utilize a hand-held speed measuring and camera device to detect speed violations throughout the city. Civil notices of the violations are then processed and sent out to violators. Violators will receive several options including an appeal hearing process if they wish to challenge the violation.

An officer utilizing the hand -held device fulfils the "Officer Present" requirement as outlined and required in SB 342.

Fine amounts and late fees of $85 and $50 as listed in original Ordinances have not changed.


FISCAL & STAFF IMPACT: Fiscal impact includes possible increased revenues from violation fines and late fees. Staff impact includes increased time spent on administration and processing of the systems. However it is expected that continued and dedicated use of the hand-held systems will create better driver awareness and ultimately reduction of crashes throughout the City. Crash reductions will greatly impact the Police and Fire departments through reduced responses across the board.

Other Positive Impacts most likely to result in the following:

-More time for Police Crews to spend on proactive patrols in neighborhoods.
-More time for Police Crews to deal with Criminal activity including drug interdiction and enforcement.
