AN ORDINANCE BY THE TROTWOOD CITY COUNCIL FOR AUTHORIZING THE SPECIAL ASSESSMENTS TO PROPERTY OWNERS FOR THE 2016 STREET PAVING PROGRAM ACCORDING TO O.R.C. CODE 729.09 MADE BY CONSTRUCTING, REPAIRING, AND/OR REPLACING CERTAIN SIDEWALKS, CURBS, GUTTERS AND DRIVEWAY APPROACHES ON N. BROADWAY FROM MAIN STREET TO THE BRIDGE ON NORTH BROADWAY (NORTHBOUND).

PURPOSE: To issue written notice to each owner and or agent of each parcel of land abutting upon the sidewalk from Main Street to North Broadway at the bridge (Northbound) that needs repair or service to its sidewalk and curbing. The city has prepared a listing of the identified parcels the need repair and included same with this report.

INFORMATION: The City of Trotwood has been awarded an $83,000.00 Montgomery County Community Development Block Grant to resurface North Broadway from Main Street to the Bridge on North Broadway. One of the requirements for these federally funded dollars is the Sidewalk, Curb and Gutter must be repaired prior to resurfacing the roadway. Therefore, the City is declaring that certain specified sidewalks, curbing or gutters along North Broadway are constructed and or repaired. Upon passage of resolution by City counsel of same, written notice will be served on the owner and or agent of each identified parcel of the declaration. Furthermore, if sidewalks, curbing or gutters are not constructed or repaired within fifteen (15) days from the service or notice provided in section 903.02 of the codified ordnances, the director of Public Service may proceed by direct employment of labor or by contract, to carry out the construction or repair at the expense of the owner.
